Court orders USAGM to reopen, restoring media operations and press freedom

The U.S. District Court for the District of Columbia has granted a preliminary injunction in the case of “Widakuswara v. Lake,” finding that the U.S. Agency for Global Media (USAGM) was unlawfully shuttered by the administration, Acting Director Victor Morales, and Special Adviser Kari Lake. This decision mandates that USAGM continue its functions and safeguards the editorial independence of its journalists, including those at Voice of America (VOA) and other media outlets like Radio Free Asia.

This ruling was welcomed by journalists, federal workers, and unions as it protects First Amendment rights and resists undue political interference in public broadcasting. AFGE National President Everett Kelley stated, “Today’s ruling is a victory for the rule of law, for press freedom and journalistic integrity, and for democracy worldwide.”

AFSCME President Lee Saunders highlighted the ruling as a major win for AFSCME members and VOA workers, emphasizing, “The judge’s message is clear – this administration has no right to unilaterally dismantle essential agencies simply because they do not agree with their purpose.”

Jon Schleuss, President of NewsGuild-CWA, reflected on the decision’s significance: “Journalists hold power to account and that includes the Trump administration.”

Various supporters, including Government Accountability Project Senior Counsel David Seide and Andrew G. Celli, Jr., counsel for the plaintiffs, expressed satisfaction with the court’s decision. Celli remarked, “VOA is more than just an iconic brand with deep roots in American and global history; it is a vital, living force that provides truth and hope to those living under oppressive regimes.”

The ruling was also praised by Democracy Forward President and CEO Skye Perryman and Tom Yazdgerdi, President of the American Foreign Service Association, highlighting the important role of independent journalism in democracy and countering disinformation.

Clayton Weimers, Executive Director of RSF USA, commended Judge Lamberth for recognizing the Trump administration’s improper actions, urging USAGM to act swiftly to implement the ruling and return over 1,300 VOA employees to their roles.

Ambassador Norm Eisen, co-founder and executive chair of the State Democracy Defenders Fund, emphasized that this decision is vital in restoring the rule of law and ensuring a free and independent press.

Although this decision marks just the beginning of what might be a prolonged legal battle, it represents a significant victory for the press, federal workers, and their unions, reaffirming protection for those who speak truth to power.
